1. Acceptance of Terms

PocketCmd ("the App") is made by Moodyprogramming FZE ("we", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on the phones, tablets and computers you own or control, strictly in accordance with these Terms and the App's documentation. The free tier can be installed on as many of your devices as you like. A PocketCmd Pro purchase covers up to 3 devices at a time, as described in section 3.

3. PocketCmd Pro purchases

PocketCmd is free to use, and the free tier stays free. PocketCmd Pro is an optional upgrade that unlocks extra features. You can get Pro as a monthly or yearly subscription, or, while lifetime licenses are available, with a one-time lifetime purchase. All three unlock the same features. Here is how buying and using Pro works:

• Buying in the App Store or Google Play. On iPhone, iPad and Android, and on a Mac when you installed the App from the Mac App Store, Pro is an in-app purchase, billed by Apple or Google to your store account. Subscriptions renew automatically, at the same price and for the same period, until you cancel. To avoid the next charge, cancel in your App Store or Google Play account settings at least 24 hours before the renewal date. Billing, cancellation and refunds for store purchases are handled by Apple and Google under their own terms (Apple Media Services Terms, Google Play Terms of Service). We cannot issue refunds for store purchases ourselves; please request them from Apple or Google.
• Buying through Paddle. For the builds downloaded from this website (macOS, Windows and Linux) and for the Windows app from the Microsoft Store, Pro is sold through Paddle. Our order process is conducted by our online reseller Paddle.com, which is the merchant of record for all these orders: Paddle processes your payment, issues your invoice, and handles sales tax and VAT. Paddle's Buyer Terms apply to these purchases. Subscriptions renew automatically until you cancel. You can cancel at any time through the link in your Paddle receipt email or in Paddle's customer portal; Pro then stays active until the end of the period you have already paid for.
• Refunds for Paddle purchases. You can request a full refund within 14 days of any payment made through Paddle, whether it is a lifetime purchase, the first payment of a subscription or a renewal. Ask through the link in your Paddle receipt email, in Paddle's customer portal, or by writing to [email protected]. Approved refunds go back to your original payment method, normally within 14 days of approval, and the license key from that purchase is revoked (see Revoked keys below). After the 14-day window, payments are not refundable, except where the law where you live says otherwise; the statutory right to withdraw from a purchase is set out in Paddle's Refund Policy, and nothing in these Terms limits it.
• Lifetime purchases. A lifetime purchase is a single payment with no renewal. It covers Pro, including every update we release, for as long as PocketCmd Pro is offered. If we ever stop offering Pro, we will tell you at least 6 months in advance and release a final version of the App in which your lifetime license unlocks Pro without our license server, so the Pro features you paid for keep working. A lifetime purchase does not expire; it only ends if it is refunded or charged back. Lifetime licenses have limited availability, and we stop selling them once they are gone; that does not affect lifetime purchases already made.
• Your subscription price is locked. As a subscriber, you keep the price you subscribed at for as long as your subscription keeps running. If your subscription ends and you subscribe again later, you pay the price that applies at that time.
• License keys and devices. Every Pro purchase comes with a license key. If you buy through Paddle, we email the key to you. If you buy in the App Store or Google Play, you can create it in the app under Settings → PocketCmd Pro → Use on other devices. A key is personal to you as the buyer. One purchase works on up to 3 devices at the same time, on any mix of platforms. A device that uses an App Store or Google Play purchase directly takes one of those 3 slots and confirms the purchase with our license server about once a day; it keeps its slot while it is in use, and its Pro lapses after 14 days without a check-in. You can free the slot of a device that uses the key by deactivating that device in the app, and a key slot that has not been used for 60 days frees up on its own. Please do not share or publish your key.
• Revoked keys. A key is revoked after an approved full refund or a chargeback, whether it happens through Paddle, the App Store or Google Play. We may also revoke a key that is abused, for example one that has been shared publicly. A revoked key no longer unlocks Pro. A refund in the App Store or Google Play also ends the Pro access that came with that store purchase.
• When a subscription ends or a purchase is refunded. Nothing you created is deleted. The free limits apply again: 1 saved server, 1 server group, 1 dashboard and 1 workspace. You choose which server, dashboard and workspace stay active (the one you used most recently is preselected). That choice is made once and stays final for as long as the app is on the free tier. Everything else stays stored on your device and can still be exported, but is locked (servers don't connect, dashboards are read-only, workspaces don't open). It all comes back as soon as Pro is active again.
• No account needed. You do not need an account to buy or use Pro. Your license key is all you need.

4. User Responsibilities

You are solely responsible for:

• Maintaining the confidentiality and security of your server credentials, SSH keys, and any other authentication information
• All activities and actions performed through your use of the App
• Ensuring you have proper authorization to access any servers, systems, or resources you connect to through the App
• Compliance with all applicable laws, regulations, and third-party terms of service
• Any data you access, modify, transfer, or delete through the App

5. Prohibited Conduct

You agree not to:

• Use the App for any unlawful or unauthorized purpose
• Access servers, systems, or networks without proper authorization
• Distribute, upload, or transmit malware, viruses, or malicious code
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Circumvent, disable, or interfere with security-related features of the App
• Use the App in any manner that could damage, disable, overburden, or impair any server or network

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that:

• The App will meet your requirements or expectations
• The App will be available at any particular time or location, uninterrupted or secure
• Any defects or errors will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POCKETCMD, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Updates and Modifications

We may modify, suspend, or discontinue the App or any part of it. If we discontinue PocketCmd Pro, we give at least a 6 months' notice: lifetime purchases are handled as described in section 3, subscriptions stop renewing from the day we announce it, and any period you have already paid for that runs past the end is refunded pro rata. We may also update these Terms from time to time. Your continued use of the app following any changes constitutes your acceptance of the revised Terms.

9. Termination

We may terminate or suspend your access to the App, or revoke your license key, if you breach these Terms, for example by sharing or publishing your key (section 3) or by using the App for prohibited conduct (section 5). Upon termination, your right to use the App will cease immediately. Discontinuing the App or PocketCmd Pro is covered by section 8.

10. Governing Law

These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates as applied in Dubai. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.
